Welcome to DailyIdeaz (https://dailyideaz.com). By using our website and services, you agree to comply with the following terms. If you do not agree, do not use the service.

1. Overview

DailyIdeaz is an idea-capture web application designed to help you build a daily habit of writing ideas. You can capture, develop, and grow a backlog of ideas over time.

2. Accounts

To use DailyIdeaz, you must create an account and provide accurate information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be of legal age to form a binding contract in your jurisdiction to use this service.

3. User Content & Ownership

You own your content. All ideas, notes, and other content you create on DailyIdeaz belong entirely to you. We claim no ownership over your content.

By using the service, you grant DailyIdeaz a limited, non-exclusive license to host, store, back up, and display your content solely for the purpose of providing and improving the service. This license ends when you delete your content or your account.

We do not use your content for AI model training, advertising, or any purpose beyond providing you the service.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Upload content that infringes on the rights of others
• Attempt to gain unauthorized access to the service or its systems
• Reverse engineer, decompile, or disassemble any part of the service
• Use automated means (bots, scrapers) to access the service
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the service

We reserve the right to suspend or terminate accounts that violate these terms.

5. AI Features

DailyIdeaz may offer AI-powered features to enhance your experience (such as idea suggestions or analysis). Regarding these features:

• AI outputs are suggestions only and may be inaccurate, incomplete, or unsuitable for your purposes
• AI outputs do not constitute professional, legal, financial, or any other form of advice
• You are solely responsible for how you use or act on AI-generated content
• We make no warranties regarding the accuracy, reliability, or fitness of AI outputs
• Your content is not used to train AI models

6. Payments & Refunds

DailyIdeaz offers a one-time payment for access to the service. Pricing is subject to change with reasonable notice.

Payments are processed by a third-party payment processor. By making a purchase, you agree to the payment processor's terms of service.

Refund policy: You may request a full refund within 14 days of purchase. After 14 days, all sales are final. To request a refund, contact support@dailyideaz.com.

We reserve the right to modify our pricing or payment model in the future. Any changes will be communicated in advance and will not affect existing purchases retroactively.

7. Intellectual Property

The DailyIdeaz name, logo, design, and underlying code are the property of DailyIdeaz. You may not copy, modify, or distribute any part of the service without prior written consent.

This does not affect your ownership of the content you create (see Section 3).

8. Termination

You may delete your account at any time. Upon deletion, your data will be removed in accordance with our Privacy Policy.

We may suspend or terminate your account at our sole discretion if you violate these terms, abuse the service, or engage in conduct that we determine is harmful to other users or to DailyIdeaz. We are not liable to you for any suspension or termination.

9. Disclaimer of Warranties

DailyIdeaz is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, secure, or free of harmful components. You use the service at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, DailyIdeaz, its owner, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of business opportunities, arising out of or related to your use of the service.

Our total aggregate liability for any claims arising from or related to the service is limited to the amount you have paid to DailyIdeaz in the 12 months preceding the claim, or $50 USD, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless DailyIdeaz, its owner, operators, and affiliates from and against any claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the service
• Your content
• Your breach of these terms
• Your violation of any law or regulation
• Your violation of any third-party rights

12. Dispute Resolution & Arbitration

Please read this section carefully. It affects your legal rights.

Informal Resolution

Before initiating any formal dispute proceeding, you agree to first contact us at support@dailyideaz.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If the dispute cannot be resolved informally, you and DailyIdeaz agree to resolve it through binding arbitration conducted by a mutually agreed-upon arbitrator. The arbitration shall be conducted on an individual basis, in the English language, and may be conducted remotely.

The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against DailyIdeaz.

Exceptions

Either party may bring a claim in small claims court if it qualifies. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

13. General

Governing Law. These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Severability. If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full effect.

Entire Agreement. These terms, together with the Privacy Policy, constitute the entire agreement between you and DailyIdeaz regarding the service.

Changes to Terms. We may update these terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of DailyIdeaz after changes constitutes acceptance of the updated terms.
